1. Objective

This policy outlines how Tradoly of Europe, SL manages email marketing communications in compliance with the EU GDPR (Reg. 2016/679) and Law 34/2002 (LSSI-CE) on Electronic Commerce.

This policy also reflects requirements under the GDPR regarding lawful processing, transparency, and user rights, as well as rules on electronic marketing communications under applicable EU ePrivacy laws.

It applies specifically to marketing emails sent in connection with Tradoly's vehicle marketplace platform.

2. Legal Basis for Communication

Tradoly sends marketing communications based on the following legal grounds:

a) Consent (Article 6(1)(a) GDPR)

Users receive marketing emails where they have given explicit, informed, and freely given consent (e.g., via sign-up forms or account settings).

b) Soft Opt-in (LSSI-CE / ePrivacy rules)

Where users have previously engaged with Tradoly's services (e.g., created an account or interacted with listings), Tradoly may send communications related to similar products or services, provided that:

  • The user was clearly informed at the time of data collection
  • The user is given a simple and free opt-out option in every communication

Registration form checkbox during account creation, newsletter subscription opt-in during onboarding, and consent selection within user account settings (Email Notification section), including during listing creation or platform registration flows where applicable

Users can withdraw consent at any time (see Section 5).

3. Marketing Emails

Types of marketing email

  • Vehicle promotions and discounts
  • Partner or affiliate offers
  • Platform feature updates
  • Newsletters and announcements
  • Event or campaign invitations

Personalization of Content:

Marketing emails may be tailored based on user activity, including:

  • Previously viewed or searched vehicles
  • Saved listings or preferences
  • Location and market trends

Price alerts for saved searches, similar vehicle recommendations based on browsing and saved listings, dealer-specific trade exclusive listing, and personalized recommendations based on user activity and preferences

4. Data Collected for Email Marketing

To send and optimize marketing emails, Tradoly may process:

  • Name and surname
  • Email address
  • User preferences (e.g. vehicle type, location, saved searches)
  • Interaction data (e.g. email opens, clicks, and engagement)

Tracking Technologies:

Marketing emails may include tracking pixels or similar technologies to measure:

  • Email open rates
  • Click-through rates
  • User engagement

This data is used to:

  • Improve email relevance
  • Optimize campaign performance

Legal Basis:

Tracking is performed based on user consent where required under applicable laws.

Consent for marketing and analytics cookies and similar technologies has been provided via the platform's cookie consent banner and settings preference management, in compliance with applicable ePrivacy requirements

5. Unsubscribe / Withdrawal of Consent

Users have the right to withdraw consent to marketing communications at any time.

This can be done by:

  • Clicking the "Unsubscribe" link included in every marketing email
  • Adjusting preferences in account settings
  • Contacting support@tradoly.com
  • Settings (Account Settings) > Notifications > Email Notifications

Withdrawal of consent does not affect the lawfulness of processing carried out before withdrawal.

Unsubscribing is immediate, free of charge, and does not affect access to the platform.

6. Data Retention for Marketing

Marketing contact data is retained:

  • As long as the user's consent remains valid, or
  • Until the user unsubscribes or objects to processing

In addition:

  • Suppression lists (records of opt-outs) may be retained to ensure compliance with unsubscribe requests
  • Engagement data (e.g. opens, clicks) may be retained for 12 months for analytics purposes

After this period, data is deleted or anonymized.

7. Third-party Processors

Tradoly uses GDPR-compliant email marketing platforms (e.g. Mailchimp) to send communications and analyze performance.

These providers act as data processors under Article 28 GDPR and process data only on documented instructions from Tradoly.

Where such providers are located outside the European Economic Area (EEA), appropriate safeguards are implemented, such as Standard Contractual Clauses (SCCs).

Google SMTP and similar GDPR-compliant email service providers and analytics platforms used by Tradoly from time to time.

Tradoly does not sell or rent email data to third parties.

8. Frequency of Communications

Tradoly aims to send marketing emails at a reasonable frequency to avoid excessive communication.

Typically no more than 2-4 marketing emails per week, depending on user activity, campaign intensity, and selected account setting preferences

The frequency may vary depending on user activity, preferences, and ongoing campaigns.

9. User Control and Preferences

Users can manage their marketing preferences, including:

  • Types of emails received
  • Frequency of communication
  • Personalization settings

Email Notifications control within account Settings > notifications, allowing users to toggle categories as promotions, recommendations, platform updates, and offers.

Changes to preferences may take a short time to take effect.

10. Profiling and Personalization

Tradoly may use profiling techniques to tailor marketing emails based on user behavior and preferences.

This includes analyzing:

  • Browsing activity
  • Listing interactions
  • Engagement with previous emails

This profiling does not produce legal or similarly significant effects.

Users can opt out of personalized marketing at any time.

Users may disable personalisation through account Settings.
